For U.S. registrations subject to Sections 8 and 9, maintaining a registration requires both declarations concerning use and periodic renewal applications.
A Section 8 declaration of use or excusable nonuse generally must be filed between the fifth and sixth anniversaries of registration. This filing maintains the registration but is not the ten-year renewal.
Between the ninth and tenth anniversaries, the owner generally must file a combined Section 8 declaration and Section 9 renewal application. Combined filings are then required at ten-year intervals, including between the nineteenth and twentieth anniversaries.
Certain filings have a six-month grace period with additional government fees. Registrations based on the Madrid Protocol follow different maintenance and renewal procedures.
